Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SafeRoute Africa mobile application and website (collectively, the "Service") operated by SafeRoute Africa ("we," "our," or "us"). Please read these Terms carefully before using the Service.

By using SafeRoute Africa, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By downloading, installing, registering for, or using the SafeRoute Africa Service, you agree to these Terms. If you do not agree, you must immediately discontinue use of the Service and delete the application from your device.

These Terms constitute a legally binding agreement between you and SafeRoute Africa. We may update these Terms from time to time (see Section 17).

2. Eligibility

To use SafeRoute Africa, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law
  • Agree to these Terms on your own behalf or, if registering on behalf of a minor between 13 and 17, as their parent or legal guardian

Users between 13 and 17 years of age must have parental or guardian consent to use SafeRoute Africa and should be supervised in their use of emergency features.

3. User Accounts

You must register for an account to access most features of SafeRoute Africa. When you create an account, you agree to:

  • Provide accurate, current, and complete registration information
  • Keep your account information up to date
  • Maintain the security and confidentiality of your password
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized access to your account at support@saferouteafrica.com

You may not share your account credentials, create more than one account, or transfer your account to another person.

You may delete your account at any time (see Section 14). We may also suspend or terminate your account in accordance with Section 13.

4. Community Conduct

SafeRoute Africa exists to protect communities. Every user has a responsibility to uphold the integrity of the platform. You agree not to:

Prohibited Activities

  • Submit false, fabricated, misleading, or exaggerated safety reports
  • Submit malicious missing person reports not based on actual missing persons
  • Harass, threaten, intimidate, or abuse other users of the platform
  • Impersonate any person, organisation, or law enforcement agency
  • Use the platform to spread misinformation, rumours, or panic
  • Use the SOS emergency feature for non-emergency, prank, or test purposes
  • Use the platform to target, discriminate against, or incite harm against any individual or group
  • Engage in any activity that violates applicable local, national, or international law
  • Use automated tools, bots, or scripts to submit reports or interact with the platform
  • Attempt to gain unauthorised access to our systems, servers, or other users' accounts
  • Upload or transmit viruses, malware, or any other harmful code
  • Collect or harvest other users' personal information without consent
False reports are a serious violation. Submitting fabricated safety incidents, false SOS alerts, or fraudulent missing person reports causes direct harm to communities, wastes emergency resources, and may constitute a criminal offence under applicable law. SafeRoute Africa reserves the right to report such conduct to relevant authorities.

5. Incident Reporting Responsibilities

SafeRoute Africa empowers users to report safety incidents in their communities. With this power comes responsibility:

  • You are solely responsible for the accuracy and truthfulness of every report you submit
  • Reports should be based on direct observation or credible, first-hand information
  • Adding photos or multimedia to reports must only include content you have the right to share
  • Reports involving individuals should not include identifying personal information beyond what is necessary
  • If you discover a submitted report is inaccurate, you should retract or correct it immediately

SafeRoute Africa uses community validation to assess the credibility of reports. Reports that receive multiple community confirmations are given higher trust scores. This validation process does not guarantee accuracy, and users should always exercise independent judgment regarding their personal safety.

6. Missing Person Reports

The missing person registry is a critical feature of SafeRoute Africa. When submitting a missing person report, you agree that:

  • The person reported is genuinely missing or their whereabouts are of legitimate concern
  • You have appropriate authority to submit the report (family member, guardian, or authorised person)
  • All information provided is accurate to the best of your knowledge
  • Photos shared have been obtained with appropriate consent or right
  • You will update or close the report when the person is found

Submitting a missing person report for someone who is not missing, for harassment purposes, or without appropriate authorisation is a serious violation of these Terms and may constitute a criminal offence.

7. Emergency Features

SafeRoute Africa is not a replacement for emergency services.
In any life-threatening situation, always contact your local emergency services first — police, medical, or fire services — before using SafeRoute Africa.

The SOS emergency button and community alert features are supplementary safety tools. They are not monitored by emergency services and do not guarantee a response from law enforcement, medical personnel, or fire services.

  • SOS alerts notify your pre-configured emergency contacts and the SafeRoute Africa community
  • SafeRoute Africa does not directly dispatch emergency responders
  • Response times depend entirely on community members and are not guaranteed
  • The platform operates on a best-effort basis and may be unavailable due to connectivity or technical issues

Always have local emergency numbers saved on your device and contact them directly in any situation requiring immediate professional assistance.

8. Intellectual Property

All content, features, and functionality of SafeRoute Africa — including but not limited to the application code, design, graphics, brand identity, logo, and safety alert system — are the exclusive property of SafeRoute Africa and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, sublicense, or create derivative works from any part of the Service without our express written permission.

Your Content

You retain ownership of content you submit to SafeRoute Africa (reports, photos, descriptions). By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute that content for the sole purpose of providing the SafeRoute Africa safety services. This licence ends when you delete the content or your account.

9. Privacy

Your use of SafeRoute Africa is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, and protect your information.

10. Service Availability

SafeRoute Africa is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

  • We may suspend or discontinue features for maintenance, updates, or unforeseen technical issues
  • We do not guarantee the accuracy, completeness, or timeliness of community-submitted safety information
  • Service availability may vary by geographic region
  • We are not responsible for delays or failures caused by circumstances outside our reasonable control

The platform is free to use and we provide it as a community service. We will make reasonable efforts to maintain availability and communicate planned downtime in advance.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SafeRoute Africa, its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of life, personal injury, or property damage arising from reliance on community-submitted safety information
  • Any harm resulting from failure to receive, act upon, or correctly interpret safety alerts
  • Losses arising from false, inaccurate, or malicious reports submitted by other users
  • Service interruptions, data loss, or security incidents beyond our reasonable control

Our total aggregate liability to you for any claims arising from your use of the Service shall not exceed the total amount you have paid to SafeRoute Africa in the twelve months preceding the claim (which is zero, as the Service is free).

Some jurisdictions do not allow limitation of liability for personal injury or consumer protection claims. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless SafeRoute Africa and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Content you submit, post, or transmit through the Service
  • Your violation of any rights of another user or third party
  • Your violation of any applicable law or regulation

13. Account Suspension

We reserve the right to suspend or restrict your account access at our discretion if we have reason to believe you have:

  • Violated any provision of these Terms
  • Submitted false, fraudulent, or malicious reports
  • Engaged in harassment, abuse, or conduct harmful to other users or communities
  • Attempted to compromise the security or integrity of the platform
  • Used the Service in a way that creates legal risk for SafeRoute Africa or others

Where possible, we will notify you of a suspension and the reason for it. Suspended users may contact support@saferouteafrica.com to appeal. In cases involving an immediate safety threat or active legal investigation, suspension may occur without prior notice.

14. Termination

By You

You may stop using SafeRoute Africa at any time. You may delete your account via:

  • In-app: Profile → Settings → Delete Account
  • Online: saferouteafrica.com/delete-account

By Us

We may terminate your account and access to the Service at any time with or without cause. Grounds for termination include, but are not limited to, repeated violations of these Terms, conduct harmful to users or communities, or extended periods of inactivity.

Upon termination, your right to use the Service immediately ceases. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

15. Governing Law

SafeRoute Africa is a pan-African platform serving users across multiple jurisdictions. These Terms are intended to be interpreted in a manner consistent with applicable law in the jurisdictions where the Service is offered.

In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation. If negotiation does not resolve the dispute within thirty (30) days, the dispute shall be referred to binding arbitration or the courts of competent jurisdiction in the location where SafeRoute Africa is legally registered.

Nothing in this Section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction to prevent irreparable harm.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

  • Update the effective date below
  • Notify registered users via in-app notification or email
  • Post the updated Terms at saferouteafrica.com/terms

Your continued use of SafeRoute Africa after the revised effective date constitutes your acceptance of the updated Terms. If you do not agree with updated Terms, you must stop using the Service.
